Terms and Conditions
1.1 BeefysBongs.com.au (“Site”) is owned and operated by a licenced Australian tobacconist (Licence number: 19401186) which is a registered Australian (“Company”)(ACN: 605 880 895). In these terms and conditions (“Conditions”), “us”, “we” and “our” refer to the Company and references to “you” or “your” is to you, the end user of the Site.
1.2 The Site is an online platform for users, whether they are members or non-members (“Users”), to purchase tobacco accessories and products associated with tobacco (“Products”) and to exchange views on the Products (“Comment Function”). Users may access the Site as a registered User or an unregistered User.
1.3 By using the Site you agree to be bound by these Conditions. If you do not agree with these Conditions, you must stop using the Site and leave it immediately.
1.4 You acknowledge and agree that the Conditions apply to any orders for product/s made over the telephone or on www.beefysbongs.com.au.
1.6 We may change, update or amend these Conditions at our absolute discretion without notice. By continuing to use the website, you agree to be bound by those changed Conditions.
1.7 All notices, enquiries, complaints can be communicated to the Company at: firstname.lastname@example.org .
1.8 Beefy's and or any related affiliates have the right to refuse service of any person for any reason.
2 Use of the site
2.1 You are granted a non-exclusive, limited and revocable license to use the Site and / or access the Comment Function on the condition that:
(a) you are over the age of 18 years;
(b) you are capable of forming binding contracts;
(c) you only use the Site for lawful purposes;
(d) you do not engage in any improper, indecent or offensive behaviour while using the Site;
(e) you are not breaking any local, state or federal law in your relevant jurisdiction (or the State that the Company is registered in) by accessing the Site or purchasing Products; and
(f) you treat the Site and its Users with respect and will not partake in any conduct that could be considered bullying, harassment, degradation, insulting or otherwise demeaning to the human standard of any other person (as determined by us).
3.1 You agree to be a member of the Site when you complete the membership registration process online or offline.
3.2 The information you provide to us during the membership registration process must be accurate and complete in all respects.
3.3 You will only represent yourself and will not create false aliases or impersonate any other person (with or without their consent) while using the Site.
3.4 You must retain access to your username and password to access the Site.
3.5 It is your responsibility to keep your username and password secure. You are solely responsible for the use of your membership account, irrespective of who is using it, even if it is used without your permission.
3.6 You agree to indemnity us against any and all liability, loss, costs and expenses arising from or incurred in connection with unauthorised access to your account.
4 User Purchase warranties
4.1 In respect of any Products that you purchase from the Site, you warrant that:
(a) you are purchasing the Products as consumer goods only and are not purchasing the Products for any medical or therapeutic purposes whatsoever;
(b) you have considered and understand the possible health risks associated with using the Products and will seek medical advice before using any Product;
(c) you will not use the Products for any unlawful purpose, including but not limited to, the consumption of any illegal substances.
5 Product Information and availability
5.1 All prices on the Site are shown in Australian Dollars (AUD) and include GST.
5.2 The colours of Products that you see depend on your computer display, so we cannot guarantee that your monitor will display the colours accurately.
5.3 You agree and acknowledge that there may be technical or administrative errors in the information on the Site, including but not limited to errors with respect to product description, pricing and availability.
5.4 We reserve the right to correct any errors without any notice, including after you have submitted an order or made a payment.
5.5 We reserve the right to limit quantities, including after you have submitted an order or made a payment.
5.6 Representations of Products for sale on the Site do not constitute an offer to sell but an invitation to treat. Such representations do not warrant that the Product is available.
5.7 If there is an error in any information that forms part of an offer from us to you, any agreement arising from your acceptance of that offer will be void at our absolute discretion.
5.8 All glass products are handmade and there may be slight variations in sizes and colouring's.
5.9 Bake on labels: Any bake on labels are prone to small imperfections and bubbling, this is due to the nature of how they are applied. This is not a product defect and you should expect some imperfections on any labels or colour wrap design products.
5.10 Due to all products being handmade there will always be some degree of small imperfections in the glass. Small bubbles, scratches and pimples are all completely normal and do not indicate a defective product.
5.11 Stems (glass) - It is the sole responsibility of the customer to measure, choose and order the correct stem length. All stem measurements on product pages are approximate and measurements should be made by the customer before ordering replacement stems. Please use our stem measuring guide on our blog, which can be found here.
5.12 Rubber grommet pipes: All rubber grommet products are a low value item and expectations of such products should match the value of the product. All of our products in this range are checked for air tightness to a satisfactory level before being dispatched from us. A few points to remember before purchasing a rubber grommet product from us, the hole in the glass under the grommet is never perfectly round, this is how they are made by hand. It is also very unlikely that they will ever be 100% air tight, they do not need to be and you may be over packing the product or the hole in the brass bowl may be too small.
5.13 We rely on our suppliers to provide specifications and in the event they do not we are only able to supply approximate measurements. We do not manufacture anything ourselves. The majority of the products on our website are hand made and they will ALL have differences to the measurements provided. Beefy's will not be held responsible for any inconsistency in manufacturers stated measurements.
6 Delivery and return of Goods
6.1 Any automated confirmation of a successful order placement and/or receipt and/or our processing of a payment for an order through the Site does not constitute acceptance of an order by us. If we decline your order after a payment for the order has been received/processed we will contact you with the details and refund the payment in full.
6.2 The Products are our absolute property at law and in equity until you have paid the full price. Until we receive full payment, if you hold a Product, you will hold the Product only as a bailee.
6.3 You agree to take on the risk for the Products, such as loss or damage, when the Products reach the delivery address.
6.4 If your order is returned to us due to circumstances outside of our control and we receive no communication from the customer. The products will become the property of Beefy's after 60 days.
6.5 If we receive no notification from you within 48 hours of the delivery date, you agree that the Products will be deemed delivered without defect.
6.6 After taking delivery of the Products, you agree to examine the Products and notify us if there are any missing or damaged Products within 48 hours of the delivery date. We will need either physical or photographic evidence of the ‘unused’ product in this time frame. Video proof will be needed if you are claiming for a "leaking" product. Damages to product packaging during shipping are not covered and replacement packaging will not be supplied. This is one of the risks of ordering online and we pack accordingly, although we have no control over how the couriers handle the parcels. Only damage to the actual product is covered under our shipping policy.
6.7 If we receive no notification from you within 48 hours of the delivery date, you agree that the Products will be deemed delivered without defect.
6.8 We are no longer accepting returns, this is due to the fact many returns had been clearly used before returning the products. Please make sure you order the correct product, including length and size. If you have any questions please discuss them with us prior to ordering. We do not offer returns under any circumstances.
6.9 You are 100% responsible for supplying the correct delivery address and any return shipping costs in either direction will be the customers responsibility.
6.10 All sales are final.
6.11 If you would like to claim for a faulty product, it must be returned in an unused state, this includes coming in to contact with residue of any substance. If you use the product you have agreed that it is acceptable quality and there will be no returns on such products.
6.12 If your payment is in any way not received and you accept delivery of the order, you are still required to pay the invoice total. If you refuse to pay, a credit collection agency will be employed to retrieve the funds. This will effect your credit rating.
6.13 Beefy's Bongs 100% owns all products until we have received your payment in full. No matter the location of said products.
6.14 By accepting a delivery from us, you are committing to pay any outstanding amount left on the invoice. Failing to do so will result in a collection service being hired to recover the funds.
6.15 Any store credits issued in good faith or any other gesture, cannot be used in conjunction with any coupon codes. They also cannot be used for the shipping/freight portion of any orders. Store credits can only be used for products.
6.16 If you claim there is a missing product. We will always do our best to make sure there are no missing products from any order and always take missing product claims seriously. Although if inventory levels match our system and the physical items and Beefy's also have the two signatures of the employees whom checked and or packed your order along with a vivid recollection of packing the orders. We will not be sending a replacement out as we believe our steps to prevent missing items are more than adequate.
6.17 Cancellation of an order. There are a couple of scenarios for this question.
If your order has been packed/prepared, we can cancel your order although there will be $25 removed from your refund to cover staff costs of packing and unpacking the order. This excludes some satchels, where we use prepaid satchels, in this case we will remove the cost of the satchel and the $25 unpacking fee from your refund.
If your order has already been shipped we are unable to stop the delivery process, you may refuse the delivery and the order will be returned to us. Please be aware the postage in both directions will be removed from the refund along with the $25 administration fee. This excludes all clearance, seconds (2nd) and special order items.
The shipping charge will be removed from your refund and will be charged at the full cost that Beefy's incurred to ship the order.
If the claim is less than $10 "before or after the administration fee has been applied" customers are not eligible for a refund.
(This is for standard refunds only, underage orders and refusing to provide proof of age fall under item 19.9 of the Terms and Conditions.)
6.18 If you provide incorrect bank details for a refund, you bear all responsibility of any lost funds or any fees that may be incurred.
6.19 If there is something missing or incorrectly sent, Beefy's have the right to refund or provide a store credit instead of reshipping the item. It is at our sole discretion. This will generally be the case for when the item is inexpensive and shipping costs more than the product is worth.
6.20 If your parcel is lost or delayed, Beefy's will lodge an enquiry with the corresponding courier service. Once the courier service has confirmed the parcel cannot be found, a replacement will then be sent out, this will only occur once we have written confirmation from the courier. This will only occur once the proper procedure has been followed, the time it takes for the courier to deem a parcel lost is out of our control. If you are requested by the courier to provide any details you must comply.
6.21 If we ship a replacement order and you receive the replacement along with the original order, you must refuse delivery or return the second parcel at your own expense. Failing to do so will result in a new invoice being issued that you will be responsible for paying, failing to do so will have a collection agency employed to recover the funds. Payment terms are strictly 7 days.
6.22 If we have shipped a replacement order and you have received compensation from the courier for the original lost parcel, you will be responsible for repaying for the second delivery. You will be invoiced and responsible for payment of the invoice, failing to do so will have a collection agency employed to recover the funds. Payment terms are strictly 7 days.
6.23 Beefy's cannot be held liable for any late deliveries, this includes express deliveries, this is outside of our control.
6.24 It is the responsibility of the customer to collect or arrange re-delivery of a parcel if they are not home to accept the delivery. Beefy's is under no obligation to organise re-delivery or collection of the parcel.
6.25 It is the responsibility of the customer to follow any procedures of the courier to organise collection or re-delivery of parcels. This includes although not limited to; filling out any forms required, contacting the courier by telephone or email.
6.26 If you request a re-delivery or a re-direct to a different address that is not your original address you are responsible for any and all fees associated with such services. If Beefy's is billed for this service we will issue an invoice that the customer is under obligation to pay. Original shipping fees do not cover any other services besides the original delivery.
6.27 If you request a re-direct to an address that is not the original address on the order, Beefy's is no longer involved in the delivery process. All communication involving the delivery to a separate address is outside of our control and the customer has now entered in to their own agreement with the courier/freight company.
6.28 Postage charges may include packaging and handling fees and may not reflect the charge that may be shown on the parcel at the time of shipping.
7 Manufacturer warranty
7.1 We are willing to facilitate a claim under the Product manufacturer’s (“Manufacturer”) warranty if you return the Product to us within the warranty period set out by the Manufacturer.
7.2 The outcome of all returns pursuant to the Manufacturer’s warranty will be at the sole discretion of the Manufacturer. You agree that we will not be responsible for the decision of a Manufacturer in respect of its warranty in any way.
7.3 If you return a Product and, in our opinion, there is evidence of:
(a) its use for unlawful purposes; or
(b) damage caused by accident, misuse, negligence or normal wear and tear; we will not facilitate a warranty claim to the Manufacturer.
(c) the product has been tampered with in any way, shape or form.
7.4 Warranties are non-transferable and are only valid for the original purchaser.
7.5 Warranty returns, it is the customers responsibility to return the product to be claimed under warranty. It is the returners responsibility to make sure the returned item is received back to us undamaged, the customer is also responsible for any returns that are lost on their way back to us. We advise that you insure and have a traceable tracking number when posting an item back to us.
7.6 Return postage is only refunded once the item has been approved for a warranty claim, if the claim is denied no postage refund will be issued. We only cover the cost of standard postage and the size of the parcel must be sent as the minimum size required. All insurance, signature on delivery and any other postage charges including packaging will be the customers responsibility. If you received free shipping either in full or part thereof, return postage is the responsibility of the customer.
7.7 We absolutely 100% WILL NOT accept used product returns. If it looks or smells like it was used, it will be disposed of immediately and no refund will be issued. There are no exceptions or negotiations available to this policy.
7.8 Breakages that occur at the hands of the consumer are not covered under warranty, this includes although not limited to, misuse or accidental damages.
8 Customs, Duties and Taxes
8.1 If you order Products from outside Australia, you agree to take responsibility for ensuring that the Products can be legally imported into the country of delivery.
8.2 You agree to pay any customs, duties or taxes with respect to the Products that we send to the address outside of Australia, including GST. With the exception of GST, these costs will be in addition to the purchase price that we quote on the Site.
9 Liability and Indemnity for products
9.1 There are inherent health risks involved in using the Products. By purchasing the Products, you acknowledge and agree that you will be using the Products at your own risk. You should consider the risks associated with the Products before you purchase and use them.
9.2 User no circumstances will we be liable for any death, injury, loss or damage of any kind whatsoever caused to you or any other person by the Products. This includes liability for any direct, incidental, consequential or indirect damages; loss of profits, economic loss, goodwill, bargain or opportunity; loss of anticipated savings or any other similar or analogous loss resulting from your use of, or inability to use, Products purchased from the Site, whether based on warranty, contract, tort, negligence, in equity or on any other legal theory, and whether or not we knew or should have known of the possibility of such damage of any type, whether in tort, contract or otherwise.
9.3 With respect to Products purchased from the Site, certain rights and remedies may be available to you under the Competition and Consumer Act 2010 (Cth), or similar legislation of other States or Territories, and may not be permitted to be excluded, restricted or modified (“Non Excludable Right”).
9.4 Where a Non Excludable Right is deemed to apply, we limit our liability for any breach to the re-supply of the Products concerned, or the payment of the cost of such re-supply, which is to be at our option.
9.5 By purchasing Products, you indemnify us (and our directors, employees and agents) (“Indemnified”) against all claims, demands, proceedings and other liability arising wholly or partially, directly or indirectly, from the Products.
9.6 Without limiting the generality of the above, you also indemnify the Indemnified against any costs, expenses, losses, damages and liability suffered or incurred by the Indemnified arising directly or indirectly from your breach of these Conditions and any negligent or unlawful act or omission on your part in connection with the Products.
10 Site Information
10.1 All the information on the Site is for informational purposes only, and is to be used or relied on at your own risk. We make no warranty or representations as to the accuracy of information on the Site.
11 Site Availability
11.1 By using the Site you agree that we accept no responsibility for the Site being unavailable, and we make no warranties or guarantees, implied or express, as to the ongoing availability of the Site in whole or in part.
11.2 You agree that we are not liable for any loss or damage that you or any other person incurs by not being able to access the Site or any part of it.
11.3 We may change, update or otherwise amend the Site at our absolute discretion and without notice.
12 Content and Publication
12.1 In respect of any content that you upload to the Site or submit to us, with or without the Comment Function, you warrant that it is:
(a) to the best of your knowledge, accurate;
(b) compliant with these Conditions;
(c) free of any computer virus or malicious code;
(d) not false, defamatory, misleading or otherwise deceptive in any way; and
(e) not uploaded in breach of the intellectual property rights of any third party.
12.2 You agree that you are liable for and indemnify us against any and all liability, loss, costs and expenses arising from or incurred in connection with your breach of any warranty in these Conditions.
12.3 We make no warranties as to the accuracy of any content posted by any User of the Site, and will accept no liability for errors or omissions in general.
12.4 We reserve the right, at our absolute discretion, to remove, amend, edit or in any other way change any post or upload by a User of the Site.
13 Intellectual property
13.1 All content on the Site is the copyright of the Company. Without the express written permission of the Company, you shall not:
(a) replicate all or part of the site in any way; or
(b) incorporate all or part of the Site in any other webpage, site, application or other digital or non-digital format.
13.2 The Company has moral & registered rights in its trademarks and you shall not copy, alter, use or otherwise deal in the marks without the prior written consent of the Company.
13.3 You agree that by using the site you will not copy any part of the Site or its function for your own commercial purposes. You agree and warrant that you will not solicit the Users of the Site to use another competing site or in any way to stop using the Site in preference of using another site offering comparable services. You indemnify us for any loss or damage we suffer as a result of your breach of this warranty.
14 Site Liability and Indemnity
14.1 You agree that you use the Site and the Comment Function at your own risk.
14.2 You acknowledge and agree that we are not responsible for the conduct or activities of any User of the Site or Comment Function.
14.3 Under no circumstances will we be liable for any direct, incidental, consequential or indirect damages, loss of profits, goodwill, bargain or opportunity, loss of anticipated savings or any other similar or analogous loss resulting from your use of, or inability to use the Site or the Comment Function, whether based on warranty, contract, tort, negligence, in equity or on any other legal theory, and whether or not we knew or should have known of the possibility of such damage of any type, whether in tort, contract or otherwise.
14.4 With respect to your use of the Site and the Comment Function, certain rights and remedies may be available to you under the Competition and Consumer Act 2010 (Cth), or similar legislation of other States or Territories, and may not be permitted to be excluded, restricted or modified (“Non Excludable Right”).
14.5 Where a Non Excludable Right is deemed to apply, we limit our liability for any breach to the re-supply of the services to which the breach is related, or the payment of the cost of such re-supply, which is to be at our option.
14.6 By using the Site, you indemnify us (and our directors, employees and agents) (“Indemnified”) against all claims, demands, proceedings and other liability arising wholly or partially, directly or indirectly, from your use of the Site or the Comment Function.
14.7 Without limiting the generality of the above, you indemnify the Indemnified against any costs, expenses, losses, damages and liability suffered or incurred by the Indemnified arising directly or indirectly from your breach of these Conditions and any negligent or unlawful act or omission of yours in connection with the Site or the Comment Function.
16 Complaints and Disputes
16.1 You agree to remove any contentious content immediately upon request by us.
16.2 We reserve the right to remove any content from the Site that you post which is the subject of a complaint by another User, regardless of whether that complaint is justified or reasonable.
16.3 If you have a complaint about content on the Site you should report it to us immediately. We may or may not investigate your complaint, depending on its nature.
16.4 If you have a dispute with us or another User in connection with the Site, you must report the dispute to us so that we may investigate and assist in the resolution of the dispute (where possible).
17.1 Either party may end the agreement arising from these Conditions immediately for any reason by giving the other party written notice. Where this agreement has been terminated you must immediately cease using the Site.
18.1 We will send you notices and other correspondence to the details that you submit to the Site, or that you notify us of from time-to-time. It is your responsibility to notify us of any updated contact details as they change.
18.2 Email notice from us to you is effective notice under these Conditions.
19.1 You acknowledge that you have not relied on any representation, warranty or statement made by any other party, other than as set out in these Conditions.
19.2 The relationship between you and us under any agreement arising from these Conditions does not form a joint venture or partnership.
19.3 No clause of these Conditions will be deemed waived and no breach excused unless such waiver or consent is provided in writing.
19.4 We may assign, novate or otherwise transfer any of our rights or obligations under any contract arising from these Conditions to a third party without notice to you, or your prior consent.
19.5 Any agreement arising under these Conditions will be governed by the laws of the state set out in the definition of Company. You agree to submit to the non-exclusive jurisdiction of courts with jurisdiction there, and it shall be the sole forum for any proceedings.
19.6 Any clause of these Conditions, which is invalid or unenforceable, is ineffective to the extent of the invalidity or unenforceability without affecting the remaining clauses of the Conditions.
19.7 Any agreement arising from these Conditions is part of an ecommerce transaction and the parties agree that the agreement shall be accepted electronically and the agreement formed & validly entered into electronically in accordance with the Electronic Transactions Act 1999 (Cth).
19.8 The termination of any agreement arising from these Conditions does not affect the parties’ rights in respect of periods before the termination of this agreement.
19.9 If you are asked to provide identification in the form of a photo ID and you do not comply your order will be cancelled immediately, this includes underage orders. There are 'NO' exceptions to this.
There will be a $25 or 25% of your order whichever is greater as an admin fee removed from your refund.
If your order is under $25 there will be no refund given. Refunds will be issued within 5 business days.
19.10 If you are asked for ID, the ID must match the name of the order, proof that you are over 18 years of age. There are no exceptions.
19.11 If you do not have any form of ID or are unwilling to provide ID if requested, do not place an order.
19.12 Your ID must not be modified in any way, do not block out any features of the ID including your face. Any ID supplied with any modifications will be denied. We will delete all traces of your ID forever once we have inspected it. If your ID is supplied modified in any we will keep a copy of the modified ID. Digital IDs are not accepted.
19.13 If there are multiple names associated with the order and this includes, names, email addresses or phone numbers. All parties involved MUST provide ID.
19.14 You must not order any restricted products on behalf of a person that is not eligible to purchase the restricted goods themselves.
19.15 By placing an order you warrant to Beefy's Bongs that you are:
- 18 years of age or older, R18+.
19.16 Refunds will incur a $10 or 10% surcharge, whichever is greater, this is to cover staff costs involved in transferring payments and communication for said refund. If the refund is issued because of an issue that is our fault, no charges will occur. (This is for standard refunds only, underage orders and refusing to provide proof of age fall under item 19.9 of the Terms and Conditions.) If the claim is less than $10 "before or after the administration fee has been applied" customers are not eligible for a refund.
20.1 One and two star reviews must have a valid reason for such a low star rating. We will not censor these reviews if a valid reason is given. One and two star reviews will not be published because you do not like the product or it does not live up to your expectation. One and two star review would be published if there is a major problem or defect with the product.
20.2 Only reviews deemed to be legitimate by Beefy's will be posted.
20.3 Product reviews are not the place to review freight companies.
20.4 Product reviews that contain obscene language or discussion of illegal activities will either be modified to suit or not be approved.
20.5 Low rating reviews where the customer/reviewer has misread, misinterpreted or expected features that are not listed or shown in images will not have their reviews published as this does not reflect the quality of the product.
21 Rewards Program
21.1 Sign up Tokins are only rewarded once per member's lifetime.
21.2 Tokins are only rewarded once per member's lifetime for following Beefy's on Instagram.
21.3 Tokins are only rewarded once per member's lifetime for liking Beefy's on Facebook.
21.4 Tokins are only rewarded once per member's lifetime for sharing Beefy's on Facebook.
21.5 1 Beefy Tokin for every $1 spent does not include the price of shipping or GST.
21.6 Beefy's reserves the right to remove Tokins from a members account if they do not follow the required action. This includes although is not limited to not following on Instagram, not liking us on Facebook, not sharing on Facebook and creating multiple accounts for additional sign up Tokins.
21.7 Tokins for spending are only issued once the order is marked as "Shipped"
21.8 The Rewards program is valid from the 16th March 2021 and there are no Tokins issued for purchases before this date.
21.9 Beefy's reserves the right to end the rewards program at anytime.
21.10 Customers must be logged in to their account to receive Tokins for purchases.
21.11 You must be an active member at the time of placing the order to earn rewards, Tokins cannot be issued for past orders.
21.12 Minimum order amount of $20 is required when making a purchase with Tokins.
21.13 Tokins (discount codes) cannot be shared and must be used with the original account that earned the reward Tokins.
